HAWTHORNE AND IVORY TERMS OF SERVICE
Thank you for visiting Hawthorne and Ivory (“Hawthorne and Ivory”, “we” or “us”). We are committed to offering custom and bespoke, high-quality paper products and a superior customer service experience.
These Terms of Service (“Terms”) cover the provision of any product or service available from Hawthorne and Ivory. By making payment and submitting your wedding information form you acknowledge that you have read and accept these Terms and that these Terms constitute binding and enforceable obligations to you.
These Terms supersede all other prior or contemporaneous oral or written agreements and may be updated at any time, without notice.
DESCRIPTIONS AND SPECIFICATIONS
Whilst every effort is made to ensure colours displayed in photographs, digital proofs and other web images are a close representation, variations in the actual printed goods may occur due to differences in calibration of computer monitors, laptop, tablet and mobile phone screens. If this is a concern it is recommended to order a sample (for bespoke orders this can be quoted on request).
Goods that have been made by hand are done so to a high and consistent standard, however we cannot ensure that every item will be exactly the same. Goods made using one off materials or a limited supply are unique, so expect variation. All measurements are rounded to the nearest cm, unless otherwise stated.
Copyright in the design, text, graphics, photographs, layout and logo contained in the website is held by or licensed to Hawthorne and Ivory. You may not copy, download, reproduce, modify, publish, redistribute, publicly display or create derivative works from the content of our website without first obtaining permission from Hawthorne and Ivory. If you are press and wish to use our images, please contact us first.
DIGITAL DOWNLOADS AND PRINTABLE DESIGN FILES
By placing an order for digital design files you agree that these files are for personal use only- you are entitled to print the designs as many times as needed for your own use. Commercial use is strictly prohibited- the sale of or redistribution of these digital files is not permitted.
Files will be provided in a format ready for professional digital printing- high resolution (300dpi) PDF files, CMYK colour format, 3mm bleed for trimming. We are not able to recommend third party print suppliers and will not be held responsible for the print results from any third party print suppliers as variation can be found between ink, card stock and hardware.
The customer is responsible for checking their proofs in particular ensuring that the colours, layout, wording, spelling and grammar are to expectations. Whilst we will do our upmost to ensure these are to the highest standard, once proofs are signed off by the customer, we cannot take responsibility for any errors missed and will need to charge for any re-prints if necessary unless errors have been made by us. It is the customer’s responsibility to ensure that the right number of prints are ordered as once the print order has been placed, it will not be possible to add additional quantities. We reserve the right to charge for further amendments to designs once proofs have been signed-off by the customer. 3 rounds of proofs are included with designs from the existing/house/'personalised design collection'. Up to 5 rounds of proofs are included with bespoke design packages. We reserve the right to charge for further changes or requests after the set amount of proofs have been provided, these would be billed at an hourly rate.
You will be asked to supply the information for your stationery and you are responsible for ensuring all the details and spelling is correct. You will have the opportunity to make changes in the initial amendments after receiving your digital proofs. All changes must be done before the design goes to print. Hawthorne and Ivory takes no responsibility of text and grammar errors once artwork has been signed off. If replacements are required, they will be charged in full.
We do our best in working with the colours we feel works well with each design, but in certain cases you may wish to change the colours to fit in with your individual theme. We are happy to do this whenever possible, but please be aware that colours can vary both between computer screens when viewing digital proofs and the final printed product. Custom colours are your responsibility, if colour reproduction is a concern it is recommended to order a sample, for custom colours samples will be quoted upon request.
Hawthorne and Ivory remains at all times the sole owner of all designs created, including bespoke stationery designs. We reserve the right to use bespoke creations in any form. Designs may later become existing/house/'personalised design collection' designs in the same or in an amended format. Exclusivity is available upon request and would be subject to licensing fees.
Bespoke design includes a full print service and designs are not available for as a digital download/ printable design package. Bespoke designs will not be released digitally or in any other format unless previously agreed by, and at the discretion of, Hawthorne and Ivory. Charges for design work do not cover the release of copyright design files including indd, psd, ai, png, or any other source files; if these files are requested, they will be subject to a separate quotation, ‘buy-out’ charge or 'release fee'.
Our samples are available as a means for the customer to see the quality of the products we offer. Due to variables in design and print, we cannot guarantee that your order will exactly replicate the sample received. With digital printing there are a number of factors that influence the final print result and exact calibration between different print runs cannot be guaranteed.
We are dependent on suppliers whose product lines can vary. We aim to update the website and our customers of any changes as soon as they come in to effect.
It is the customer’s responsibility to ensure that the order is correct. We retain the right to reject orders at any point during the order process. Alterations to orders may be made at our discretion after proofs have been signed-off with a cost incurred for the customer. It is the customer’s responsibility to notify us of any alterations to orders as soon as possible. The customer must pay for orders in full before the final product is released for delivery.
DEPOSITS AND PAYMENT
Payment for goods may be made by electronic bank transfer or cheque. All necessary details are provided on the invoice. Payments made by cheque must be fully cleared before any design work is to begin.
For bespoke orders the non-refundable design fee must be paid before your order is confirmed and we can begin work on your stationery designs. You will be invoiced for the remaining balance (i.e. print costs) on your order when all artwork has been signed off by yourself. This will be payable within 5 working days. We will not print your stationery until the remaining balance has been paid.
For existing/house/'personalised design collection' orders the full balance is due when the order is placed and is non-refundable.
PRICING AND AVAILABILITY
VAT is not applicable to any of our prices. We reserve the right to cancel any discounts offered either directly or through discount codes. Price quotes are given individually and are valid for 30 days from point of contact- after this a new quote will need to be requested. We will do our very best to make it clear on the website if and when there is a problem with availability on any of the items.
POSTAGE AND PACKAGING
UK orders will be sent by either Royal Mail 1st Class Signed For or DPD courier dependant on the value and weight of the parcel.
In an effort to be more eco-friendly and to reduce our carbon footprint, Hawthorne and Ivory reserves the right to use recycled packaging such as bubblewrap, cardboard wraps and boxes when shipping parcels.
International shipping is available and rates are quoted on an individual basis. Any custom fees or import tax incurred during shipping are your responsibility. Hawthorne and Ivory is not responsible for delays caused by customs.
REFUNDS AND RETURNS
As all products offered are bespoke, personalised and/or made to order, they cannot be returned or exchanged. If a product arrives faulty or damaged please contact us within 10 days of receiving it and we will arrange how is best to put the situation right. Please contact us regarding any issues with your order as soon as you can.
For bespoke orders, the design fee is non-refundable. If you wish to cancel after the design fee has been paid and before your stationery goes to print, you will not be required to pay the remaining balance. For both bespoke orders and orders from the existing/house/'personalised design collection', once you have paid the print invoice, the sale becomes final and non-refundable. If the order is cancelled by Hawthorne and Ivory at any point your order will be refunded in full.
By submitting feedback, suggestions or ideas (collectively, “Feedback”) to Hawthorne and Ivory through the Website or any of our communication channels (including, but not limited to, email, phone, chat, blogs, and online surveys), you acknowledge and agree that your Feedback automatically becomes the property of Hawthorne and Ivory without any obligation to you, that Hawthorne and Ivory may use or disclose that Feedback for any purpose, and that you are not entitled to compensation or reimbursement of any kind from Hawthorne and Ivory.
We do our best to ensure that every product and service on our website is sold subject to description. Whilst we aim to keep the website up-to-date as possible, the information you see may not always completely represent the product 100%. We reserve the right to make any changes to any information on the website at any time.
From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).
Hawthorne and Ivory is committed to ensuring that your privacy is protected and to prevent unauthorised access a number of physical and electronic measures have been put into place. Should we ask you to provide certain information by which you can be identified when using this website, you can be assured that it will only be used in accordance with this privacy statement.
You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. THE DATA WE COLLECT
We may collect the following information:
- Name, email address, shipping address, billing address, contact phone number.
- Other information relevant to the completion of your order- e.g. wedding date, time, location, written information for details cards and other specific information relating to your wedding.
WHAT THIS INFORMATION IS USED FOR
We use the personal information submitted to us to fulfil your requests for products and services as well as record keeping.
We use anonymous information, such as web pages viewed, to analyse trends, provide a better website experience and to gather broad demographic information for aggregate use.
Any information you contribute to public areas of our website or social media pages, including information about yourself, product reviews, and any other suggestions or comments, is publicity available, can be collected and used by others, and may appear on third-party sites.
Your stationery and also photographic images of your stationery may be used for marketing purposes (i.e. samples, social media and blog posts), if this is the case any personal/identifiable details will be anonymised. You may request for your invitations to not be used in this manner at any time.
HOW LONG WILL THIS DATA BE KEPT
Hawthorne and Ivory will not retain your personal information longer than necessary. We will hold onto the information you provide as needed to be able to provide the services to you, or for as long as is necessary to provide support-related reporting and trend analysis only. Your design files will be kept active until your wedding date has passed and then securely archived for a period of 2 years after this. An anonymised version of bespoke design files will be retained indefinitely for portfolio records.
If legally required or if it is reasonably necessary to meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce our Terms and Conditions, we may also retain some of your information for a limited period of time as required, even if it is no longer needed to provide the services to you (i.e. for tax purposes invoice records will be retained for a period of 7 years).
INFORMATION SHARING AND DISCLOSURE
Hawthorne and Ivory will not rent, sell, or share personal information about you with other people or nonaffiliated companies except to provide products or services that you have requested, or unless we have otherwise obtained your permission. We may share personal information as needed with trusted contractors, vendors and partners who work with or on behalf of Hawthorne and Ivory under confidentiality agreements. These third parties do not have any independent right to share this information and are also compliant under data protective legislations.
CONTROLLING YOUR PERSONAL INFORMATION
You may choose to restrict the collection or use of your personal information in the following ways:
- If you have previously opted in to us using your personal information for direct marketing purposes, you may change your mind at any time by following the ‘opt out’ instruction within any such email.
- You may request details of personal information which we hold about you under GDPR.
- You may request deletion of your data at any time by emailing firstname.lastname@example.org. Certain data must be held due to regulatory requirements.
If you believe that any information we are holding on you is incorrect or incomplete, please email us as soon as possible. We will promptly correct any information found to be incorrect.
